From the moment the consumer accesses the site birrificiodelducato.it, they agree to abide by the terms and conditions outlined below, including all referenced documents. Users are encouraged to carefully review this document before using the services.

Art. 1 – Purpose of this contract

This contract concerns the sale of beer, food products, as well as accessories in the quantity and quality chosen by the consumer through the selection of products on the site birrificiodelducato.it. The goods and services for sale are those described on the pages of birrificiodelducato.it. The data provided there may be subject to change and periodic updates, also with the aim of further improving the service for the consumer.

Art. 2 – Prices and product availability

The prices of the products referred to in Art. 1 are listed on the site and are inclusive of VAT. To the product price must be added the shipping cost where applicable, the amount of which, always indicated on the site, varies according to the requested delivery method, in addition to any customs duties. In the event that the product is not available, the consumer will be promptly informed via email. The prices and availability of products marketed by Birrificio del Ducato Srl through the site birrificiodelducato.it/shop are subject to change without notice.

Art. 3 – Purchase contracts entered into by minors

The purchase of products containing alcohol (such as beer) can only be made by individuals who are at least 18 (eighteen) years of age. Birrificio del Ducato Srl is exempt from any liability in case of purchase by a minor under 18 (eighteen) years of age, who has provided false information about their age or false indications to purchase the goods and/or to access the data on the site. In any case, parents are directly responsible for the payment of purchases made by their children under the age of 18 (eighteen), without prejudice to the right of withdrawal as per Art. 6 of these conditions of sale.

Art. 4 – Orders/Invoicing

Orders are accepted through this website. The conclusion of the contract is subject to the receipt of the order by Birrificio del Ducato Srl. The receipt (or invoice, if expressly requested at the time of the order) will be sent concurrently with the delivery of the goods, within the times prescribed by law.

Art. 5 – Delivery of goods

The delivery of goods takes place within the terms reported on the site, at the address indicated by the consumer and via the courier appointed by Birrificio del Ducato Srl. Where expressly provided, direct pickup at the headquarters of Birrificio del Ducato Srl located at Strada Argine 43, 43019 Soragna (PR) is possible during the times and methods expressly indicated at the time of the order. It should be noted that, in order to more efficiently deliver the goods, Birrificio del Ducato Srl will communicate the telephone number provided by the consumer at the time of the order to the courier, which will be used in compliance with the privacy legislation of Legislative Decree no. 196/2003. If the recipient is absent at the time of delivery, the courier will leave a message/notice to agree with the customer on another delivery time or allow the pickup of the package at the nearest courier location. 

The consumer, at the time of receipt/pickup of the goods, is required to verify the integrity of the goods and their correspondence to the order, a check to be carried out in the presence of the delivery agent. If the package’s wrapping appears damaged, the consumer must ACCEPT the package and note the damage on the bill of lading/transport document. If the package appears intact, the consumer must accept it and may sign the delivery receipt with the note “ACCEPTED WITH RESERVATION FOR INSPECTION”. If one or more products are found to be damaged or do not correspond to the order placed, the consumer, only if they have previously noted the damage on the bill of lading/transport document or accepted with a reservation for inspection, must inform Birrificio del Ducato Srl via email at ordini@birrificiodelducato.it within 3 (three) working days from the delivery, also providing photographic documentation related to the damage or incorrect supply, the proof of which rests on the consumer. 

Birrificio del Ducato Srl reserves the right to request the return shipment of the damaged/incorrect goods at the consumer’s expense, which must occur within 15 days from the request by Birrificio del Ducato Srl, under penalty of losing the right to replacement or refund. Birrificio del Ducato Srl, having verified the existence of the damage or incorrect supply, at its own expense, within no later than 30 days from the date of delivery or reporting, will also proceed to replace the damaged/incorrect products or, if this is not possible, to reimburse the consumer for their amount. In the event that the customer contacts Customer Service after the third working day, it is at the discretion of Birrificio del Ducato Srl to decide to open a case for the possible replacement of the damaged/incorrect goods.

Art. 6 – Right of Withdrawal

The consumer may exercise the right of withdrawal no later than 10 working days from the date of receipt of the goods. This right must be exercised by sending a registered letter with acknowledgment of receipt to the headquarters of Birrificio del Ducato Srl, currently at Strada Argine 43, 43019 Soragna (PR). The communication can be anticipated, within the same period, also by email to ordini@birrificiodelducato.it or by fax to +39.0524.932630, provided that it is confirmed by registered letter with acknowledgment of receipt within forty-eight (48) hours thereafter. The goods must be returned to Birrificio del Ducato Srl intact, in unchanged conditions and complete with the original packaging, at the consumer’s expense no later than 15 days from the communication of the withdrawal. 

Birrificio del Ducato Srl will credit the corresponding amounts within a maximum of 30 days from the date of receipt of the registered letter and in any case not before having received the goods and checked the state of the goods subject to withdrawal. The costs and risks related to the return of the products will be borne by the consumer. It is specified that European legislation provides that the right of withdrawal is exercisable only by natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. Therefore, the right of withdrawal CANNOT be exercised by legal entities and by natural persons who act for purposes related to a commercial activity. The right of withdrawal is also excluded for purchases made by resellers or by subjects who in any capacity purchase for resale to third parties. The right of withdrawal does not apply to the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or alter rapidly. It is also specified that, in the case of premium operations (the so-called promotions), in which the purchase of one good is linked to another good that is sold at a nominal price or given for free, the right of withdrawal can be legitimately exercised with the return of both goods subject to the purchase, given the accessory nature of the good in promotion with respect to the first.

Art. 7 – Limitation of Liability

Birrificio del Ducato Srl assumes no responsibility for any damage resulting from the use or improper use of the service provided by the site birrificiodelducato.it. Birrificio del Ducato Srl is not responsible for errors and omissions within birrificiodelducato.it or any website to which reference may be made or linked. Birrificio del Ducato Srl reserves the right to continuous updates of the site birrificiodelducato.it which can be made at any time. Information may contain inaccuracies of any kind or typographical errors. 

Birrificio del Ducato Srl does not guarantee that the services provided by birrificiodelducato.it will be performed without interruptions, which will be anticipated except for causes not dependent on the will of Birrificio del Ducato Srl. Birrificio del Ducato Srl disclaims any liability to the purchaser or third parties for direct or indirect damages (including, by way of example, loss of profits, revenues, business opportunities) arising from or related to a product or service provided by Birrificio del Ducato Srl, or from the use or inability to use the same. Birrificio del Ducato Srl assumes no responsibility for disservices attributable to chance or force majeure, such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that could prevent, in whole or in part, the execution in the agreed times of the contract. 

Birrificio del Ducato Srl will not be responsible for damages, losses, and costs incurred as a result of the non-execution of the contract for the above-mentioned causes, with the consumer possibly only having the right to the return of the price paid. Except in cases of intentional misconduct or gross negligence, the right to compensation against Birrificio del Ducato Srl cannot exceed the price of the products purchased by the consumer and for which the dispute has arisen.

Art. 8 – User/Consumer Responsibility

The user is required to ensure that their data entered are truthful, complete, updated, and to communicate promptly any changes to them. In the case of false statements, Birrificio del Ducato Srl reserves the right to exclude such individuals from its user lists, after a formal and unaccepted invitation to self-correct.
